4:47Now PlayingTrish Regan reports in the breaking developments surrounding the appointment of Special Counsel David Weiss to prosecute Hunter Biden.
Though Biden had initially agreed to a plea deal, the deal broke down after a U.S. District Court judge asked prosecutor David Weiss whether or not Biden could still be charged for illegal foreign lobbying.
Weiss said he could — but, the defense team for Hunter Biden said that was not the understanding.
As such, Judge Maryellen Norieka said she could not sign the agreement.
Following fireworks in the courtroom, General Merrick Garland said that prosecutor David Weiss asked to be appointed Special Counsel in order to be most independent — and he obliged.
