Earlier in the day, the U.S. Court of Appeals for the D.C. Circuit found the President's appointments were unconstitutional because the Senate was in pro forma session, not recess, as required to constitute a recess appointment.
Senator Wicker was among 42 Senators supporting an amicus brief filed last year by Republican Senate Leader Mitch McConnell (R-Ky.) that challenged the constitutionality of "recess appointments" made by President Obama to the National Labor Relations Board (NLRB) on Jan. 4, 2012. The brief was filed in Noel Canning v. National Labor Relations Board.
