April Cadena had major leg surgery and was ordered by her doctor to use a wheelchair and not to use crutches. One day after she was discharged by the hospital, she was arrested by El Paso police.
At the prison, they refused April from using a wheelchair, forcing her to use crutches, despite her surgeons orders. While carrying her food tray back to her cell (while also using crutches at the same time ....) the predictable happened - she fell, and injured her to the extent that she required additional major leg surgery.
In today's legal analysis, we review the application of the American's with Disabilities Act as it applies to jails and prison, and how qualified immunity governs this situation.
