YouTube Description
as posted by the channelThe Supreme Court transgender sports ruling is here. In West Virginia v. B.P.J. and Little v. Hecox (decided June 30, 2026), the Court held that states may maintain women's and girls' sports for biological females without violating Title IX or the Equal Protection Clause. Justice Brett Kavanaugh wrote the majority opinion, joined by Roberts, Thomas, Alito, Gorsuch, and Barrett. The headline vote was 6-3 on the constitutional question — but on the Title IX question, it was effectively 9-0: even Justices Sotomayor, Kagan, and Jackson agreed that claim fails.
We break down the whole thing without the fog machine: what Title IX actually meant in 1972, why "sex" means biological sex, the Justice Thomas concurrence, Kavanaugh's zero-sum argument for why every roster spot matters, and the concession in the plaintiffs' own case that undercut it. We steelman the Sotomayor dissent — the factfinding/remand argument — then explain why the majority rejected it. Plus the IOC, NCAA, and USOPC policies, the real-world stakes for female athletes, and the political fallout as Democrats retreat on the issue.
