13:48Now PlayingD4vd ruling explained. On Monday, July 27, Judge Charlaine Olmedo ordered David Anthony Burke held to answer on ALL THREE counts — first-degree murder, continuous sexual abuse of a child under 14, and unlawful mutilation of human remains — and found probable cause on all three special circumstances: lying in wait, murder for financial gain, and murder of a witness. He remains held without bail. Arraignment is set for August 31, and a trial date could follow within 60 days. He has pleaded NOT GUILTY and remains presumed innocent.
Also in this breakdown: the defense's first real strategic move, putting Celeste's angry text messages on the courtroom screen and laying the foundation for what looks like a self-defense argument — and the judge striking assault material from the record with the line "she is the victim here."
I also walk through the genuine weaknesses in the prosecution's case, because you should hear them from me: the Uber driver who doesn't remember the ride, the surveillance system that overwrote itself, and why the lying-in-wait allegation is the softest of the three.
Plus the legal point that ends the "she told me she was 18" excuse permanently.
