► The video deposition of Dr. Richard Abrams was played during the trial of Jeffrey Thelen v. Somatics LLC on June 1, 2023. This deposition was taken on August 2, 2018.

Jeffrey Thelen sued Somatics, alleging the manufacture failed to warn about the known risks associated with its ECT electroshock therapy medical device. These risks include brain damage, severe permanent memory loss, permanent neurocognitive injuries, and others.

On June 8, 2023, after seven days of trial, a Florida jury returned a verdict that Somatics failed to warn about the risks. The jury did not conclude, however, that this failure to warn was the proximate (legal) cause of Mr. Thelen’s injuries. Mr. Thelen has requested a new trial arguing that, because his design defect claim was dismissed; improper instructions were given to the jury; critical evidence was excluded at trial (including a video of the doctor showing he was not fully aware of the risks); and Somatics’ counsel made improper statements in closing argument (misstating the law on proximate cause), Thelen was not given a fair trial and, in the interest of justice, a new trial should be granted.
