Carly Gregg was 14 when she shot & k!lled her mother, Ashley Smiley, 40, at their Brandon, Mississippi home on 3/19/24. The weapon was loaded and unsecured in the bedroom of Ashley & her step-father. As her mother lay on the floor, she used her mother's phone to text her step-father, Heath Smiley to find out when he was coming home, and allegedly lay in wait, attempting to k!ll him as well. Heath survived. Evidence also showed that Carly called a friend to come over to show her her mom's body. Carly, now 15, was tried as an adult, was charged with 1st degree M*rder & Attempted M*rder, and tampering with evidence. During trial, the jury was shown a video of Carly's actions before & after taking her mother's life. The defendant asserted an insanity defense, and medical experts testified on both sides. A plea deal of 40 years was rejected by the defendant.
Carly was held in jail, in solitary confinement for 23 hours a day, since her arrest.
After 4 days of trial, and less than 2 hours of deliberations, the jury returned a verdict of Guilty on all 3 charges, and after a sentencing phase, the jury sentenced her to 2 life sentences WITHOUT possibility of parole, plus 10 years. Judge Dewey K. Arthur ruled the sentences shall run concurrently. Had the jury found Carly NGRI (not guilty by reason of insanity) she could have been confined to a mental health facility.
A Motion for a New Trial was denied and an Appeal was filed. The MIssissippi Supreme Court will hear oral arguments on 5/27/26.
