In an exchange with Sen. Sheldon Whitehouse, D-R.I., the federal appeals court judge stated she "didn't know that they were different or that it was a lower standard from the ones" that other federal judges are required to file.
Sen. Whitehouse said the issue is "a question of interpretation and practice" and one she may soon face if confirmed to the court.
Barrett is on Capitol Hill for a final round of questioning Wednesday before the Senate Judiciary Committee.
