Judge Gregory Carro said officers in Altoona, Pennsylvania, improperly searched Mangione's backpack earlier that day when they arrested him at a McDonald’s restaurant, and that evidence must be suppressed.
The ruling is a setback for state prosecutors, who will still be able to use the gun and notebook as evidence, and Mangione’s state trial is set to begin Sept. 8.
