The judge appointed four independent legal experts, known as amicus counsel, to evaluate the question of subject matter jurisdiction, and their findings are striking.
At the core of the legal argument is the concept of adversity. For a case to proceed in federal court, the parties must have opposing interests. Here, Trump filed suit against the IRS in his personal capacity, but as president he controls the IRS commissioner, the attorney general, and the Department of Justice, all of which are parties involved in this litigation. The appointed counsel noted this is entirely unprecedented, distinguishing it from United States v. Nixon, where the special prosecutor operated independently from presidential control.
Trump has publicly acknowledged the unusual nature of the situation, admitting he has control over the lawsuit from behind his desk. The appointed attorneys laid out a roadmap for the judge to dismiss the case and flagged a series of questions she would need answered before allowing it to continue.
Trump is pushing hard to settle before the upcoming hearing, believing a signed settlement would shield the case from further judicial scrutiny. That settlement would create a $1.7 billion fund drawn from taxpayer money, with distribution controlled by a five-member commission entirely appointed and removable by Trump, potentially directing funds toward January 6th defendants and groups like the Proud Boys and Oath Keepers ahead of the 2026 midterms.
