Two days after Hawk, a trial attorney, walked through the motion to dismiss in the Lincoln Memorial Reflecting Pool case, the prosecution has folded. The felony vandalism charges against David Hearn, a former Olympic canoeist, have been dropped. Hawk had predicted exactly this outcome once Hearn's lawyers moved for the unredacted grand jury transcripts, and he explains why that request was the pressure point.
The government's own dismissal filing tells the story. According to the motion, it was only after the indictment that the Department of the Interior provided additional documents showing the damage to the reflecting pool stemmed from a flawed installation by a contractor rushing to finish before the America 250 celebrations, not from vandalism. The sealant had reportedly begun peeling almost immediately after the renovation. Hawk notes the filing tries to shift blame to the Interior Department, which he argues only underscores that felony charges were brought against an American without an independent investigation.
Hawk sets the dismissal against Donald Trump's repeated public claims that he had photos and video of a 350-foot gash being cut into the pool, evidence never produced. He places it in a pattern of high-profile cases out of the D.C. US Attorney's office that have stumbled, and argues it reflects what happens when prosecutorial power is used to pursue targets rather than evidence.
