Todd Blanche was just confirmed Attorney General 50 to 49. Hours later, he released a 21 page opinion holding that executive privilege reaches private citizens who advise the president, so long as the communications touch official decision making.
The timing is the story. Legal historian Holly Brewer's read is that the document was written while Blanche was still acting AG and kept from the senators voting on him, Republicans included. Amanda Carpenter put it simply: a new Attorney General and a new immunity. Chuck Todd's point is that the memo's existence is an admission the White House expects subpoenas aimed at the private parties who did business with Trump and his family.
Josh Gerstein noted it landed while courts are already fighting over testimony from outside advisers, Boris Epshteyn in particular. Marcy Wheeler added the background there. This is aimed squarely at congressional oversight, and it works alongside a White House that has no intention of complying with subpoenas anyway.
Former federal prosecutor Paul Butler discussed the memo's reach with Peter Alexander.
