ICE agents are now forcibly entering private residences across America with administrative warrants that have never been reviewed or signed by a judge. This practice represents a direct violation of Fourth Amendment protections against unreasonable search and seizure. The Department of Homeland Security issued an internal memo in May 2024, signed by acting ICE director Todd Lyons, authorizing officers to use force entering homes based solely on administrative warrants rather than judicial warrants.
Administrative warrants are signed by ICE supervisors, not judges or magistrates. These warrants require no probable cause review by a neutral judicial officer. The Fourth Amendment explicitly requires law enforcement to obtain judicial warrants before entering private residences. DHS's own 2025 legal training materials state that physical entry into a home without a judicial warrant violates constitutional protections.
The memo has not been widely distributed within ICE. Instead, senior officials verbally train new agents on this policy while withholding physical copies. This suggests leadership knows the practice is unconstitutional. Meanwhile, ICE removed education requirements for new hires, resulting in agents with minimal understanding of civics, constitutional law, or the difference between administrative and judicial warrants.
The Minneapolis raid captured on video exemplifies this problem. Fifteen ICE agents with guns drawn and a battering ram broke into a home, pointed an AR-15 at a five-year-old child, and arrested a 75-year-old man in his underwear. They had the wrong address and only possessed an administrative warrant. A whistleblower complaint obtained through Whistleblower Aid reveals the extent of this constitutional crisis. Brett Kavanaugh's Supreme Court ruling created exceptions to Fourth Amendment protections, leading to what advocates now call Kavanaugh stops, racial profiling stops targeting anyone appearing Hispanic or speaking Spanish.
