Jack Smith testifies publicly before the House Judiciary Committee on January 22nd following his closed-door deposition. This examination covers the superseding indictment charging Donald Trump with four felonies related to January 6th and efforts to overturn the 2020 election. The indictment details conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and conspiracy against rights. Trump lost the 2020 election but spread false claims about outcome determinative fraud for over two months following election day on November 3rd, 2020.
The indictment identifies co-conspirators including Rudy Giuliani, John Eastman, Sidney Powell, and Kenneth Cheesebro who pursued unlawful means to discount legitimate votes and subvert election results. Trump pressured Vice President Mike Pence to fraudulently alter certification proceedings despite Pence insisting he had no constitutional authority to reject electoral votes. The fake electors scheme targeted seven swing states: Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin. On December 19th, 2020, Trump tweeted for supporters to come to Washington DC on January 6th, promising it would be wild.
The Supreme Court immunity decision required a superseding indictment because Jeffrey Clark's involvement at the Department of Justice was deemed an official act. Jack Smith stated he has evidence beyond a reasonable doubt proving Trump's guilt on all four felony charges. The attack on the Capitol delayed certification for approximately six hours while crowds chanted hang Mike Pence and breached the building at 2:13pm. The certification finally concluded at 3:41am on January 7th when Pence announced the results in favor of Joe Biden and Kamala Harris.
