ICE Unlawfully Detains Second Grader in Texas - Why Officers Should Be Worried About State Charges

A Vermont second grader was detained by ICE along with their undocumented mother and transported to a detention facility in Texas, over 2,500 miles from home. The 7-year-old child didn't show up for school, prompting frantic calls from school administration to the father, who had no idea where his child was. School personnel discovered the second grader was being held at an ICE facility in Texas after the mother was found with fraudulent documents. The school district superintendent and administration hired an attorney and sent money to the Texas detention facility so the child could access necessities while detained.

ICE has scheduled a hearing for January, meaning this 7-year-old will be held for over a month despite laws prohibiting prolonged detention of children. The father remained at home in Vermont, likely avoiding ICE officers who might have detained him as well.
