The Fourth Amendment wasn't written in a vacuum. It was written by people who lived under the boot of warrantless searches, general warrants, and government agents who could detain anyone without cause. Hawk walks through the full historical record of the Fourth Amendment, from its ratification on December 15, 1791, to landmark Supreme Court rulings that define how it applies today, including to non-citizens.
The Katz case of 1967 reshaped Fourth Amendment jurisprudence entirely, establishing that the amendment protects people, not places, and that reasonable expectations of privacy are the constitutional standard. That doctrine has held for decades, covering unreasonable searches and seizures in both criminal and civil contexts, including immigration enforcement.
Court cases including Brown v. Texas, INS v. Delgado, and Torres v. Madrid make clear that detaining someone to demand identification without reasonable suspicion is a Fourth Amendment violation, full stop. Multiple circuit courts have confirmed that illegal aliens inside the country hold the same Fourth Amendment protections as citizens

The man at the center of this case arrived in the United States as a minor, holds lawful work authorization, has a valid driver's license, and had valid tags on his vehicle. The unmarked car that pulled him over had no license plates.
