Federal Judge Paula Xinis orders the immediate release of Kilmar Obago Garcia from ICE custody after the government is caught lying to the court. Garcia, originally detained in March and wrongfully sent to Secot prison in El Salvador with 252 other men, faced systematic torture before courts ordered his return. The Supreme Court unanimously affirmed his due process rights were violated. Upon return, the government indicted Garcia on human trafficking charges in what appears to be retaliatory prosecution.
Judge Xinis details how ICE and DHS attorneys falsified evidence and misled the court about deportation plans. Costa Rica offered Garcia refugee status, but the government tried forcing deportation to Uganda, Eswatini, Ghana, and Liberia instead. Each African country either refused or was never contacted. Government attorneys submitted false sworn declarations claiming Costa Rica withdrew their offer. When ICE official Jonathan Cantu testified, he admitted spending only five minutes preparing and had no knowledge of the case. Costa Rica confirmed their refugee offer remained firm and unconditional.
The judge found no valid removal order existed and detention served only as punishment, violating immigration law. Garcia lived in the US since 2012 under ICE supervision following an immigration judge's 2019 decision granting withholding of removal under the Convention Against Torture. The court's scathing opinion exposes systematic government misconduct, falsified testimony, and vindictive prosecution against someone who successfully challenged wrongful detention. Judge Xinis issued additional orders preventing ICE from re-detaining Garcia, allowing him to reunite with his family after nine months of unlawful custody.
