Trump issued a federal pardon for Tina Peters, a former Colorado county clerk convicted of election fraud crimes following the 2020 election. Peters broke multiple laws by providing unauthorized access to voting machines and voter data in an attempt to prove false claims about election fraud. She was convicted by a jury on state charges and sentenced to prison time. The pardon Trump issued is completely ineffective because presidential pardon power does not extend to state crimes. Peters can only be pardoned by the Colorado governor, Jared Polis, who has refused.
Despite knowing the pardon has no legal effect, Trump's Department of Justice announced a retaliatory investigation into Colorado's state prison system. Peters' attorneys filed a motion claiming Trump's federal pardon removes state court jurisdiction over her conviction, citing the 1795 Whiskey Rebellion as precedent. This legal argument represents desperate attempts to manufacture jurisdiction where none exists. The Colorado Appeals Court will hear arguments on her conviction in January.
Federal trial courts continue blocking the Trump administration's unlawful actions through enforcement of evidentiary rules and judicial orders. DOJ attorneys face accusations of lying to courts, misrepresenting evidence, and calling unqualified witnesses. The administration's disrespect for the judicial branch threatens rule of law, from district courts through appellate levels. Judges appointed for life terms remain insulated from political pressure, allowing them to check executive overreach. Courts demand admissible evidence rather than television talking points, exposing the gap between political rhetoric and legal reality. The judicial system provides the primary resistance to executive branch lawlessness as attorneys face potential contempt charges for disregarding court orders.
