Tucker Carlson revealed that Republican members of Congress were briefed Tuesday about Trump's plan to announce a Venezuela war declaration during his Wednesday evening address to the nation. The constitutional issues are stark: presidents cannot declare war under the Constitution, as that power belongs exclusively to Congress. Neither the House nor the Senate has authorized military action against Venezuela.
The Trump administration has been conducting strikes against Venezuelan fishermen since early September, labeling them as narcoterrorists and drug traffickers without providing evidence. Federal judges have repeatedly ruled against the administration's treatment of young Venezuelan men, including the case of Kilmargo Garcia, who suffered abuse after being sent to El Salvador's maximum security prison based on false claims about Tren de Aragua gang membership.
Venezuela is located 2,500 miles from the United States in South America. Trump recently claimed the navy has Venezuela surrounded and called it "stolen land," despite the country being a sovereign South American nation. The administration has offered no rational explanation for the boat strikes or evidence that those targeted were criminals or cartel members.
Marco Rubio and other Republicans who were briefed on the Venezuela military action plans have remained silent. The legality of presidential war declarations without congressional approval raises serious constitutional questions. Any military orders stemming from an unconstitutional war declaration would be illegal orders, and military personnel should remember that only Trump has immunity from criminal prosecution, not Defense Secretary Pete Hegseth or service members carrying out commands.
