On Friday, after both sides had rested in the case against Herbert Swilley, the defense team brought up an issue of a juror possibly sleeping during witness testimony. The attorney who is helping the defense told the judge that one of the jurors looked like he was sleeping and ultimately asked that he be removed and replaced with an alternate juror.
