Motes’ attorneys argued that the indictment should be dismissed because it is too vague for a death‑penalty case. Judge Lindsay H. Burton did not make a ruling, stating that she will take the arguments under advisement and review case law. Fox, who suffered physical abuse, including a broken arm, and was exposed to drugs before her death, was discovered in the trunk of a car in Oct. 2025.
