The Fair Labor Standards Act sets out what overtime is. Overtime hours are calculated by any hour over 40 in one work week, not 80 in a pay period, not done yearly, not done daily. It's just 40 hours in one work week. If you go to 41, you now have one hour of overtime, etc.
