Attorneys Brian Kabateck and Shant Karnikian break down the DOJ's investigation of Cassidy Hutchinson, the former White House aide whose bombshell 2022 testimony before the January 6 committee implicated Trump in the Capitol riot. The probe — opened after a referral from Trump ally Rep. Barry Loudermilk — is being handled not by the D.C. U.S. Attorney's office where perjury cases normally go, but by the Civil Rights Division under Harmeet Dhillon, a Trump loyalist. The reason is telling: Jeanine Pirro's office has suffered repeated failures trying to prosecute Trump's political opponents in D.C. federal court, so DOJ leadership bypassed her entirely. Brian and Shant walk through what Hutchinson actually testified to — Trump's comments about armed supporters ("I don't effing care that they have weapons"), the disputed limo steering wheel incident she admitted was hearsay, and Giuliani's comments the night before the riot. They explain the difference between firsthand testimony and hearsay, why reporting what someone told you isn't perjury, and how Hutchinson was pressured before testifying to "just say I don't recall." Even some DOJ officials are skeptical there's a viable case. This is political retribution routed through a division that's supposed to handle voting rights and hate crimes — not settle the president's personal scores.
