The policies halted asylum, green card, work permit, and citizenship applications for people from predominantly African, Asian, Latin American, and Middle Eastern nations. Judge McConnell found the policies arbitrary and capricious, contrary to federal law prohibiting nationality-based discrimination, and rooted in "unlawful bigotry against immigrants." The most damning policy directed USCIS officers to treat nationality itself as a negative discretionary factor. Brian and Shant note the list includes Cuba and Venezuela, countries whose citizens the U.S. has historically welcomed as refugees from persecution. The government cited a 2025 National Guard shooting by an Afghan national as justification, but Judge McConnell found no reasoned explanation for why that incident required suspending benefits for countries as diverse as Nigeria, Tonga, and Venezuela. The court also cited Trump's own "shithole countries" comment as evidence of anti-immigrant animus behind the security pretext. Democracy Forward, which represented the plaintiffs, called it a reaffirmation that "the federal government cannot shut down lawful immigration pathways or discriminate against people based on where they come from."
