Barbara. Brian explains the new order, titled "Continuing to Protect the Meaning and Value of American Citizenship," tries to stretch the 14th Amendment's narrow historical exceptions, covering children of diplomats and invading enemy forces, into a broad new "alien enemy" designation that could sweep in ordinary foreign nationals. A companion order targets so-called birth tourism. Shant notes plaintiffs in both the Barbara and Casa v. Trump cases have already asked federal judges to expand their existing injunctions to cover the new orders, and civil rights groups asked a New Hampshire judge to block it within days of signing. Brian and Shant argue roughly a quarter of the order restates existing law on birth tourism, while the rest directly contradicts the Supreme Court's own reaffirmation that the 14th Amendment covers nearly everyone born on U.S. soil. Shant's bottom line: this is the same failed playbook as the travel ban, reissue a struck-down policy with different words and force the courts to relitigate it, and it's doomed to lose again.
