John Cornyn asked Brown Jackson about comments she made in a prior legal brief that he claimed referred to President George W. Bush and Defense Secretary Donald Rumsfeld as "war criminals." The judge did not recall making the statement, which was part of a legal brief in her defense of a member of the Taliban while she was a federal public defender. Later in the hearing, Sen. Dick Durbin clarified that Brown Jackson did not call them "war criminals" but accused their offices of actions that would constitute war crimes.
