Question: My wife booked a flat with Lodha two years back. We took a loan from ICICI. There was a demand letter and ICICI delayed the payment because of which we have been imposed penalty by Lodha. This was highlighted to ICICI and there was supposed to be a discussion between those two. ICICI bank has paid the penalty from my account. They sent us a revised letter but nobody replies from ICICI on this. How to go about this issue?
Answer: There is a clause in buyer’s agreement that says that if the builder doesn’t get the money on time then the buyer will have to pay a certain amount of charge to the builder. Now in your case, it’s because of the ICICI you are in the problem. So in that case you take this matter to the court and keep fighting till ICICI doesn’t pay the reimbursement.
