Question: Our flat share certificate is under our name. The title is clear. A third person has claimed his share in our flat. He gave a simple request letter from his advocate to the society about this. This letter is not any government department letter. He does not have any official documents supporting his claim. On the basis of this 3rd party request, the society is not approving the sale of our flat. What can we do?
Answer: The society is concerned with its member alone and cannot act on the basis of third party claims unless these are backed by a court order restraining you from transferring or parting with possession. I suggest you approach the Assistant Registrar of Cooperative Societies for help.
