Question: I have looked at some flats in Bengaluru. The land is a Khata, but due to certain deviations in the plan approved by the BBMP, the builder is unable to get OC. The deviations include additional floors and improper setback. I'm sceptical of buying a flat. These apartments are funded by national banks. The builder says he will get me a loan from these banks, while the bank is prepared to give the loan without an OC. Is it legally ok to buy such a flat?
Answer: The stage of construction and approved plan of the proposed flat is required to be checked. The construction is to be carried out as per approved plan. Possession can be taken on receipt of Occupation certificate.
