Question: I booked a flat in Sushant Golf City by Ansal group Lucknow. The project had land issues. Development is pending since 2010. I booked the flat in 2011. The issue is with the Lucknow Development Authority. The land issues have been resolved. They plan to relocate the affected building. The builder has increased the number of floors to 19 from 9. However, no development is happening and construction is yet to begin. I have paid 25% of the amount. How can we force the builder to start construction?
Answer: It is not clear whether there is an agreement signed. If yes, review the agreement to ascertain the provisions for the delay and the recourse available. Write to the builder seeking an update on the project and the proposed date of possession. In the event there is no revert, you may opt to file a case in the appropriate court for appropriate reliefs in civil court/consumer court. You can also explore to terminate the agreement and seek refund along with damages.
