Question: I invested Rs 27 lakhs in a housing society project by a developer 3-4 years back. But the developer has not started the constructed. When I asked him for refund he offered me a shop in one of his shopping mall. That shop already has a tenant. So he refuses to make a sale deed because of the Income tax department has frizzed its accounts by which they cannot sell any asset of that company. But he is saying that he can do an agreement of sale with me, he will give me the NOC and also he will help in doing a lease agreement for the tenant who is already in the shop. What should I do?
Answer: If the builder is willing to make the lease deed that would do if it is for 90 - 99 years. But still every state has some different and local laws, so you should consult a property lawyer and get the proper agreements drafted with all proofs. Do not proceed further without any legal help.
