Question: In 2012 my son booked a flat in Jaypee Greens, Noida. Provisional allotment letter (PAL) was issued in September 2012. The possession was supposed to be get on March 2016. He has deposited around Rs 50 lakhs on the total of Rs 65 lakhs on the basis of demands raised by the builder time to time. Now construction has stand stalled for last one year. What legal recourse can I take to get the flat or for refund with interest?
Answer: You can file a case in civil court or consumer court. Ask builder for possession of the flat. If you want to take refund over the possession is delayed then ask for the current market price of that flat or also you can ask for refund of the money with interest and compensation.
