Question: I purchased a flat in Noida Sector 78. The flat measures 1250 sq. ft. The builder has given me one free covered parking along with flat. Total cost of the flat as stated in allotment letter is Rs 66 lakh inclusive of 1 free covered parking which costs Rs 4 lakhs. Whether I have to pay the stamp duty on Rs 66 lakhs or on Rs (66+4) = 70 lakhs. Builder has given us offer of possession stating that I have to register my free covered parking at a cost Rs 4 lakh also along with flat.
Answer: By law, the developer cannot sell parking area. If he asking you to pay separately for the parking area that means there is some fishy. Hence you should tell the developer that this was not mentioned in the agreement. Hence forth you should not pay separately for the parking area.
