Q: My society is undergoing redevelopment. The society changed the developer on the basis of instructions given by the original developer. However, the deputy registrar is not recognising the new developer. We have already paid Rs 2 crore. What legal course should we take now?
A: The entire redevelopment process in Maharashtra is governed by a circular issued by a registrar as far back as January 2009 under Section 79 (A) of Maharashtra Co-operative Societies Act. This is a mandatory circular and the process that needs to be followed by societies is mentioned in it. So this process is normally followed in the first instance, and the registrar must be consulted before changing developer.
