The 17-year-old minor girl and her father sought an abortion in high court, but the high court judge, instead of giving judgement, made a shocking statement and said girls gave birth at age 17, and the judge also quated Manusmriti. He said, In the past, it was normal for girls to marry young and deliver their first child before they turned 17. The judge, who also urged the lawyer to read the Manusmriti in this regard, has sought medical opinion from the Rajkot civil hospital on whether it is advisable to abort the survivor’s seven-month-old foetus.
"Judges should stick to interpretation of law, and not bring their mindset to the courtroom", says Ranjana Kumari.
"There was no reason to talk about a document (referring to Manusmriti), which is claimed to be biased", says Abha Singh, Lawyer.
