They first make an independent determination: grant asylum or decide you don’t qualify. 📄 If they think you don’t qualify, then they look at whether you have valid status at that exact moment. If you don’t, your case is referred to immigration court. If you do, you receive an NOID and, if you can’t change the officer’s mind, a final denial. 🔍 It’s a common misconception that USCIS denies asylum because someone has TPS or another legal status. That’s simply not how it works. If they thought you qualified, they would have granted it regardless of your status. ⛔ But a final denial might not be the end of the road.
