Relentless & violent terroristic attacks—that’s what America’s border heroes, ICE & CBP, have been subject to hundreds of times by thousands of protestors over many months outside of the ICE facility in Portland Oregon. These well-organized, well-trained, and well-funded terrorists have repeatedly attempted to breach the ICE facility, damaged & blockaded the property, and assaulted federal officers with improvised weapons such as rocks and fireworks. With ICE & CBP vastly outnumbered and in the complete absence of support from local law enforcement, these federal officers have defended themselves against these terroristic attacks using only non-lethal crowd-control devices, such as flash-bang grenades and OC dispensers.
That was too much for unelected, black-robed, tyrannical, inferior, federal district trial court judge Michael Howard Simon, however, appointed by President Barack Obama and confirmed by the Senate on June 21, 2011 by a vote of 64–35. When approached by three protestors and two journalists alleging that the federal officers defending themselves against these terroristic attacks with only non-lethal defensive tools violated their First Amendment rights, Judge Simon seized the opportunity to kneecap the ability of ICE and CBP to act in lawful self-defense.
On February 3 Judge Simon issued a two-week temporary restraining order, which he further extended by another two weeks, and then a durable preliminary injunction on March 9, in which the judge crafted an entire set of holistic non-lethal use-of-force policies that he imposed on ICE & CBP, acting vastly outside the legitimate legal authority of any unelected, black-robed, tyrannical, inferior, federal district trial court judge. He also issued orders on how ICE & CBP officers were to be uniformed while defending themselves against terroristic attack, including seizing the purported authority to literally “redesign DHS uniforms.”
Naturally, the Trump administration objected and filed an immediate appeal with the 9th Circuit, on March 18, asking for an immediate administrative stay—or pause—of Judge Simon’s insanely over-reaching injunction while the matter was being appealed on the merits. Yesterday, March 26, a three-judge 9th Circuit Court of Appeals panel voted 2-1 to order that stay—with two Trump appointed judges voting for the stay. The third judge wrote in dissent—no surprise, really that this third judge, Ana Isabel de Alba, is a 2023 Biden appointee confirmed by a Senate vote of 48-43.
Administrative stays are granted only very rarely, and only when the consequences of allowing a reckless lower court’s order to go into effect would be potentially catastrophic—but that’s exactly what the 9th Circuit three-judge panel granted in this case, even before considering on the legal merits Judge Simon’s order kneecapping federal officers’ ability to defend themselves against repeated and ongoing terroristic attack.
Thought the stay order is very brief—only three pages, including the dissent of Biden-appointed Judge de Alba—it follows on the heels of the Trump administration’s March 18 in-depth motion requesting that administrative stay, which we must presume the three-judge panel found compelling.
Today we’ll take a look at that March 18 motion for a rare administrative stay in Dickinson v. Trump, as well as yesterday’s grant of the requested administrative stay.
