President Trump has notched yet another decisive victory over the obstructionist Democrat federal judges working overtime to sabotage his lawful enforcement of America's immigration laws.
In REACH v. DHS, the Ninth Circuit Court of Appeals just stayed a Portland district court's preposterous preliminary injunction that had handcuffed ICE and federal officers from using non-lethal crowd control to disperse violent rioters attacking the Portland ICE facility. The activist district judge invented a brand-new "constitutional right" out of thin air, claiming neighbors had a substantive-due-process right to be free from tear gas drift.
The Ninth Circuit panel obliterated this nonsense, holding there is no such right anywhere in the Constitution's text, structure, or history. As the court bluntly put it, "our Constitution is not a NIMBY charter." The decision is a stinging rebuke to a rogue unelected, black-robed, tyrannical, inferior, federal district trial court judge (appointed, OF COURSE, by BIDEN) who tried to seize day-to-day operational control over federal law enforcement.
This case exemplifies how Trump Derangement Syndrome has infected the federal judiciary, with leftist judges willing to shred the separation of powers and trample the Article II Executive's plenary duty to faithfully execute the laws.
The Constitution, Trump, and the American people achieved victory in this 9th Circuit decision enabling ICE to defend itself against violent terrorists.
