Today the Supreme Court heard oral argument in a pair of cases that strike at the heart of constitutional separation of powers: President Trump's effort to terminate Temporary Protected Status (TPS) for nationals of Haiti, Syria, and other countries, many of whom have been living "temporarily" in the United States for ten or twenty years.

Congress enacted the 1990 TPS statute with explicit language barring Article III judicial review of these Article II Executive Branch determinations, and the Trump administration rightly contends the statute "covers the waterfront."

Yet a parade of obstructionist lower-court federal judges has been blocking the President's lawful exercise of his statutory and constitutional authority. Their workaround? A laughable distinction that they aren't reviewing the Executive's decision to end TPS, only how he arrived at it.

That is a transparent fiction designed to substitute the policy preferences of unelected judges for the judgment of the duly elected President in matters of immigration and national security, areas where the Supreme Court has historically given the Executive sweeping deference.
