In a lengthy dissent, Judge Menashi argues Trump was denied basic legal protections, improperly blocked from asserting presidential immunity defenses, denied a jury determination on key liability questions, and subjected to inconsistent legal standards throughout the case.
The dissent goes even further, calling the proceedings a “manifest miscarriage of justice” and questioning how an $83.3 million verdict was allowed to stand despite procedural contradictions and jury findings that directly conflicted with the trial judge’s conclusions.
