In a lengthy dissent, Judge Menashi argues Trump was denied basic legal protections, improperly blocked from asserting presidential immunity defenses, denied a jury determination on key liability questions, and subjected to inconsistent legal standards throughout the case.
The dissent goes even further, calling the proceedings a “manifest miscarriage of justice” and questioning how an $83.3 million verdict was allowed to stand despite procedural contradictions and jury findings that directly conflicted with the trial judge’s conclusions.
This isn’t just about the facts of the Carroll allegations anymore. The real issue now is whether the legal process itself was fundamentally broken.
