as posted by the channelThe Alabama redistricting battle is heading back toward the Supreme Court—and Solicitor General John Sauer is arguing that lower federal courts are illegally forcing states to draw congressional districts based on race.
At the center of the fight is Alabama’s Republican-favored congressional map, which produces a projected 6-1 Republican advantage. A lower federal court threw out that map and imposed a court-drawn alternative designed to create an additional Democrat-leaning majority-minority district.
But after the Supreme Court’s recent decision in Louisiana v. Callais, Sauer argues the legal foundation for those race-based districting orders has collapsed. According to the filing, federal courts are improperly confusing partisan politics with racial discrimination and are overriding the constitutional authority of state legislatures to draw congressional maps.
Andrew walks through Sauer’s arguments, the Purcell doctrine, racial gerrymandering claims, and why the outcome could directly affect the balance of power in the U.S. House of Representatives.
