GA Appeals Court Ensures Trump Won't Be Tried Before Election
"The Georgia Court of Appeals, which agreed to hear the appeal of the refusal to disqualify DA Fani Willis from the case, has set oral arguments for October 4.
Judge Scott McAfee denied Trump and other co-defendants' joint motion back on April 4. Trump then appealed his ruling and the Court of Appeals eventually agreed to accept the appeal, which was discretionary on their part. Judge McAfee ordered that pretrial motions and discovery should continue while the appeal is pending, but with the appeals court setting oral argument so far out there is no possible way this case will go to trial before the election.
The motion sought to disqualify Willis and her office from prosecuting the case, and also asked the court to dismiss the indictment. The basis of the motion was her romantic relationship with Nathan Wade, an attorney who was in private practice that was brought in to assist in the prosecution. The court was satisfied their relationship did not begin until after Wade began working for the DA's office. Although McAfee denied the defense motion, he did order Wade be removed from the case."
