Trump's Lawyer Has A SHOCKING Conflict Of Interest In Stormy Daniels Case

According to the state bar rules in New York, Donald Trump's lawyer Joe Tacopina might be BARRED from representing the former president in the Stormy Daniels case that he is preparing to be indicted for. Daniels had reached out and had conversations with Tacopina about representing her, and even though he did not take her case, the bar prohibits lawyers from taking cases where they've had contact with both sides about representation. If Donald Trump does in fact get indicted for the Stormy Daniels payoff, his lead lawyer on the case Joe Tacopina, could end up being removed due to a stunning conflict of interest that Mr. Tacopina apparently has in this particular issue. Here's what happened about five years ago before Stormy Daniels hired Michael Avanti to, uh, represent her. She first reached out to Mr. Tacopina and said, Hey, Mr. Tacopina, stormy Daniels here, Stephanie Cliffords, um, here's my case. Would you be interested in representing me? And the two had a conversation about it. But ultimately Tacopina decided he was not going to represent Stormy Daniels as she fought back against Donald Trump, but now he is representing Donald Trump as he fights off against Stormy Daniels. Now, you may yourself be wondering, but fair and how is that a conflict of interest? He didn't take her case. No, he didn't. But he listened to her side of the case and he is now representing the other guy on the other side of that case.

So he does have inside information from Stormy Daniels and under New York State law, he is legally required to recuse himself from that case. Here is what it is. This is from, uh, law Professor Ryan Goodman. Quote, even when no client lawyer relationship ensues, a lawyer who has had discussions with a prospective client shall not use a reveal. Information learned in the consultation that's actually from, uh, uh, uh, a b a rule 1.18. A lawyer subject to that rule shall not represent a client with interest materially adverse to those of a prospective client in the same or a substantially related matter if the lawyer received information from the prospective client that could be significantly harmful to that person in the matter. If a lawyer is disqualified from representation under this paragraph, no lawyer in afor an affirm with which that lawyer is associated, may knowingly undertake or continue representation in such a matter.

To put it another way, you talk to her about the case. Therefore, you're not legally under the, uh, uh, a b a rule 1.18 allowed to represent Donald Trump in the case, even if it's not the same case. The rule states it's similar, it involves the same people in ABA Rule 1.18 clearly says, yeah, that meets the definition, take a hike. Now, we don't know for certain if Trump is getting indicted tomorrow, but we do know that Taina has of course, emerged as Trump's lead lawyer on this particular issue. But if, if any savvy legal minds or well-connected lawyers out there wanted to, I don't know, file a bar complaint alleging

That he has too much info from Stormy Daniels, uh, herself to properly represent Trump and not violate Bar Association rules, I would think they have a pretty strong case and robbing Donald Trump of his most powerful and most educated lawyer days after he's indicted. Man, that would just be icing on the cake, right? So let's hope that maybe somewhere out there, a well-connected lawyer or perhaps a politically savvy attorney knows how to file these bar complaints and immediately moves forward with it because again, a b a rule, 1.18 makes it clear that what Tacopina has experienced in his past should disqualify him immediately from representing Donald Trump in the future.
