A judge told Virginia to stop running background checks on private gun sales.
Virginia read the order…
and started running them anyway.
That’s the real story here.
Not just background checks. Not just another gun law. This is about a state government openly deciding that a court order doesn’t apply to them.
Back in October, a judge issued a permanent injunction blocking Virginia’s private-sale background check system. Then Governor Abigail Spanberger signed HB 1525, the State Police quietly flipped the system back on, and the injunction was never lifted.
The state just acted like it was.
And the “emergency clause” they used to justify it didn’t even clear the 80% threshold required in Virginia, meaning the law’s actual effective date was July 1st — not the day they started enforcing it.
So now Gun Owners of America and the Virginia Citizens Defense League are asking the court to hold the State Police in contempt.
This is bigger than background checks.
Because when the executive branch decides it can ignore a judge’s order on guns, the question becomes: what else will they ignore next?
A judge said stop.
Virginia said make us.
