Sen. Tammy Duckworth (D-IL) clashed with Secretary of State Marco Rubio over President Trump’s detention and deportation of Venezuelans living in the U.S. under a 1798 law targeting agents of foreign enemies during wartime.

“This is a wartime act. Are we at war with Venezuela?” Sen. Duckworth asked Secretary Rubio during a Senate Foreign Relations Committee hearing on Wednesday.

“What the president was talking about are these gangs … and these narcoterrorist groups that are waging war on the United States,” he replied.

President Trump has invoked the Alien Enemies Act — last used to intern Japanese Americans during World War II — to detain Venezuelans in the U.S. The White House has argued that many of those detained are agents of gangs aligned with the Maduro regime, a claim Democrats dispute.

“The Trump administration has acknowledged that the vast majority of the men it rounded up and deported to torture had no criminal records whatsoever,” Sen. Duckworth said.

“Who did we torture?” Secretary Rubio shot back. “We haven’t tortured anybody. We’ve arrested people that are members of gangs and we’ve deported them.”
