Join us for live coverage and analysis as the New Hampshire Supreme Court hears oral arguments in Shitbag Adam Montgomery’s appeal of his murder conviction in the tragic death of his 5-year-old daughter, Harmony Montgomery.
CASE BACKGROUND:
Adam Montgomery was convicted in February 2024 of second-degree murder and sentenced to 56 years to life in prison for killing his daughter Harmony in December 2019. Harmony’s body has never been found.
Kayla Montgomery, his estranged wife and Harmony’s stepmother, testified that Adam violently beat Harmony after she soiled herself while living in a car, then hid her body in various locations including a restaurant freezer and apartment refrigerator before dismembering her remains.
THREE GROUNDS FOR APPEAL:
1️⃣ IMPROPER JOINDER OF CHARGES - Defense argues the court wrongly denied Montgomery’s motion to separate second-degree assault charges (from July 2019) from the murder charges (December 2019). They claim trying both together was prejudicial.
2️⃣ INADMISSIBLE “BAD ACTS” EVIDENCE - Defense challenges the admission of 404(b) evidence showing Montgomery’s pattern of prior abuse and neglect of Harmony, including testimony from Kayla Montgomery about abuse in the weeks leading up to Harmony’s death.
Defense also argues Kayla Montgomery’s testimony should not have been admitted due to credibility issues, noting her story changed multiple times and she served prison time for lying to the grand jury.
3️⃣ POLICE BODY CAMERA VIDEO - Defense claims the court improperly admitted video evidence from December 31, 2021, showing Montgomery’s encounter with police (without audio), arguing it violated his constitutional right to remain silent and unfairly prejudiced the jury.
STATE’S RESPONSE: New Hampshire prosecutors argue the trial court made no mistakes and any alleged errors were “harmless beyond a reasonable doubt” and would not have changed the outcome.
