A man known online as "Chud the Builder" is facing up to 96 years in prison after deliberately approaching Black people in the South, calling them the n-word, and then shooting a Black military veteran outside a courthouse when that man reacted. He was not charged for his speech. He was charged for pulling the trigger.
Hawk breaks down what the First Amendment actually says and what it does not say. Congress shall make no law abridging freedom of speech. That means the government cannot criminalize your words. It does not mean strangers in public are required to absorb racist abuse without reacting.
The case exposes a widespread and deeply held misunderstanding among young right-wing men who believe free speech protects them from all social consequences. Chud the Builder also reportedly believes Tennessee's stand your ground law will save him, despite the fact that stand your ground does not apply to altercations you deliberately started.
