Hawk answers a comment he keeps seeing on his Lindsay Clancy videos, that the case supposedly rests on nothing but what her husband said. His response is simple and grounded in how trials work: witness testimony is evidence. Patrick Clancy testified, he was cross examined by defense attorney Kevin Reddington, and the jury weighs both his account and his credibility, something that reads very differently in a courtroom than on a screen.
The larger point Hawk makes is about what the trial is and is not about. Across a year of coverage from major news organizations, neither Clancy nor her attorney has ever denied that she killed her three children, and the defense never pointed the finger at anyone else or argued she did not do it. Reddington did not tell the jury his client was innocent of the act.
What is contested, Hawk explains, is culpability. The defense argues Clancy was insane and not criminally responsible, while the prosecution argues the killings were calculated and deliberate. Hawk points to what he sees as a major hole in the prosecution's theory, her attempt to take her own life afterward, and closes on how social media distorts these cases.
