The Trump administration is dismantling critical protections for trans and intersex people in federal, state, and local prisons through changes to the Prison Rape Elimination Act. A Department of Justice memo obtained by Prism Reports reveals that existing safeguards preventing sexual assault in detention facilities are being removed to align with Trump's anti-trans executive order from his first day in office. The memo instructs all certified Prison Rape Elimination Act auditors to ignore provisions protecting trans and intersex prisoners until new guidelines are finalized. These changes affect adult prisons, jails, juvenile facilities, and community confinement facilities operated by the DOJ, states, local governments, and private organizations.
The Prison Rape Elimination Act, passed in 2003 with enhanced LGBTQ protections added in 2012, currently mandates specific screening procedures for sexual abuse risk and housing determinations for trans and intersex people. Experts from Just Detention International warn the changes will lead to increased violence and sexual assault in detention facilities, endangering both incarcerated people and staff. The ACLU calls this a directive to disregard the law. This policy shift is part of a broader pattern of anti-trans actions including banning trans people from the military, eliminating gender-affirming care for individuals under 19, defunding inclusive health programs, removing LGBTQ youth from suicide prevention hotlines, and prosecuting parents and teachers who affirm a child's gender identity. The Department of Justice has also removed questions about gender identity from national crime surveys.
