He pointed to a troubling spike in “sensitive queries” under FBI leadership, targeting religious leaders, journalists, and political organizations. According to Durbin, these actions raise major civil liberties concerns and suggest a pattern of growing surveillance powers being used domestically.
In his remarks, Durbin said that while Section 702 is an important national security tool, “the government is using it as a backdoor for warrantless spying on Americans here at home.” He emphasized that millions — even billions — of communications involving innocent Americans are being swept up, with agencies then searching private emails, phone calls, and messages without judicial approval. He also noted that oversight bodies and the FISA court have already documented “shocking abuses” of this authority.
Durbin further criticized the current administration for weakening oversight mechanisms and keeping key court rulings secret, warning that the full extent of these surveillance practices remains unknown. He questioned the growing use of Section 702 for domestic purposes, including immigration enforcement, and warned against granting unchecked surveillance powers to top officials.
Pushing for reform, Durbin backed bipartisan legislation to require warrants before searching Americans’ data, arguing that national security and constitutional rights must go hand in hand. “If the government has a legitimate basis for the search, they can make that case to a judge,” he said, adding, “If they do not, then they should not be rifling through the private communications of Americans… Enough is enough.”
